These Terms apply to all sales made in person or through ecommerce platforms, including but not limited to [e.g., website name, eBay, Gumtree, Facebook Marketplace]. By purchasing goods from the Seller, the Buyer agrees to be bound by these Terms.
Items may be sold as new or used. The condition of each item will be clearly stated in the product listing or at the point of sale. Used items are sold “as-is” and may show signs of wear. Buyers should inspect items or review product descriptions carefully before purchasing.
All prices are listed in Australian Dollars (AUD). Full payment is required before the dispatch or transfer of goods. Accepted payment methods include [cash, EFTPOS, bank transfer, PayPal, credit card, etc.]. For online sales, payments are processed securely via the chosen ecommerce platform.
While we take care to ensure accuracy, errors may occur. If we discover an error in the price of an item, we reserve the right to cancel any orders placed at the incorrect price.
Delivery is available within Australia and may incur an additional fee, as specified at checkout or during the sale. Pickup is available by appointment from [insert address or suburb]. Risk of loss or damage passes to the Buyer upon pickup or delivery, whichever occurs first.
Returns are accepted in accordance with the Australian Consumer Law (ACL). 6.1 New Items Warranty New items sold by Webber & Chivell Drones may be covered by a manufacturer’s warranty or a limited warranty provided by the Seller, as stated in the product listing or at the time of
sale. The warranty period and coverage details will be specified where applicable. To claim under a warranty, Buyers must retain their proof of purchase and follow any applicable instructions provided. This warranty does not cover: – Damage caused by misuse, accident, or neglect; – Normal wear and tear; – Consumables such as batteries (unless otherwise stated); – Alterations or repairs made by unauthorised persons. This warranty is in addition to the rights provided under the Australian Consumer Law.
6.2 Used Items Warranty Used items are sold “as-is” and typically do not carry a warranty unless expressly stated in the product listing or at the point of sale. All known defects or issues will be disclosed prior to sale. Buyers are encouraged to inspect or ask questions about used items before purchase. Used items must still meet basic standards of acceptable quality as required under the Australian Consumer Law, unless defects have been disclosed.
6.3 Australian Consumer Law Nothing in this warranty section is intended to limit or exclude any rights you have under the Australian Consumer Law. If a product fails to meet a consumer guarantee, you may be entitled to a remedy such as repair, replacement, or refund, even if a manufacturer or seller warranty has expired. 6.4 Freight and Labour Costs Warranty coverage applies only to parts and defects as specified. Unless otherwise agreed in writing, the Buyer is responsible for any freight, shipping, or transportation costs associated with returning items for warranty assessment, repair, or replacement. Labour costs associated with installation, removal, or reinstallation of goods are also not covered under the warranty unless expressly stated. Webber & Chivell Drones is not liable for any loss, damage, or expense arising from the need to transport goods for warranty service.
To the fullest extent permitted by law, Webber & Chivell Drones is not liable for any indirect, incidental, or consequential damages. The Seller’s total liability is limited to the purchase price of the item.
These Terms are governed by the laws of Victoria, Australia. Any disputes arising out of these Terms shall be resolved exclusively in the courts of Victoria.
